Is It Legal for a School To Seize a Student Mobile Phone in Ghana?

In many Ghanaian schools, especially boarding houses and Senior High Schools (SHS), the use of mobile phones is strictly regulated or entirely banned. This often leads to teachers or school authorities seizing devices from students.

Understanding the legal balance between school discipline and property rights is essential for parents and students alike.

School Rules and the Code of Conduct

When a student enrolls in a school, they (and their parents) usually agree to abide by the school’s code of conduct. If the rules explicitly state that mobile phones are prohibited, the school has the authority to enforce this rule to maintain discipline and focus on academic work.

Seizure vs. Confiscation

There is a legal distinction between temporary seizure and permanent confiscation. While a school can seize a phone for a period (e.g., until the end of the term or until a parent comes to collect it), they cannot permanently keep or sell the student’s property. Doing so would amount to theft or illegal conversion of property.

Privacy Rights

Under the Data Protection Act, 2012 (Act 843) and the 1992 Constitution, every individual has a right to privacy. Even if a phone is seized, teachers generally do not have the right to search through a student’s messages, photos, or private data without a compelling reason (such as investigating a crime or a serious breach of school safety).

The Ghana Education Service (GES) has historically maintained a ban on mobile phones in pre-tertiary schools. While there have been discussions about reviewing this policy to include digital learning, the current standing orders usually support schools in preventing phone use on campus.
